May 2018 REACH Registration Deadline Approaches for Low-Volume Chemicals

If you manufacture or import chemicals in the EU then chances are that you have already been affected by the many REACH registration deadlines over the past few years. Even if you don’t handle chemicals directly, the products that you trade in, or use, may be part of a supply chain that could be affected by the final REACH registration deadline on 31st May 2018.

This final deadline applies to pre-registered phase-in substances that:

  • Are manufactured or imported at 1 tonne per year or more, but less than 100 tonnes per year, and
  • Are not classified under the CLP Regulation (European Regulation (EC) No 1272/2008) as Carcinogenic, Mutagenic or Toxic to Reproduction (CMR) Category 1A or 1B

The deadline is likely to concern inexperienced and small and medium-sized enterprises that manufacture or import substances in low volumes and it is expected that this last deadline will be quite different from the two previous ones (2010, 2013), in terms of both the number of registrations and the type of registrants: ECHA’s current working estimation is that up to 60 000 registrations will be prepared for up to 25 000 substances, which is three times more than for either of the previous deadlines.

Background

REACH requires that individual companies based in the UK (and elsewhere in the EU) who supply, manufacture or import chemicals, must demonstrate that they understand the properties of the chemicals and how they can be used safely. This information must be assembled in a dossier and submitted to the central authority for REACH, the European Chemicals Agency (ECHA) based in Helsinki, in an act known as a Registration.

If suppliers have not registered substances by 31 May 2018, but should have done so, they cannot continue to supply those substances.

Review your obligations

With the May deadline fast approaching it is crucial that you review your obligations.

If you are a chemical user dependent on supply, and don’t know whether chemicals relating to your business are already registered (and can’t find them on the ECHA list of registered substances) then you should take action to ensure continuation of supply by contacting your suppliers and asking about their REACH registration status for substances which are crucial to your business.
